Start with license readiness
Your license type determines whether you can practice independently, need supervision, or should set up inside a group practice first. Confirm the current rules with the state board before accepting clients.
This table is a setup readiness starting point, not a substitute for current board review.
Independent practice does not always mean clinical practice
Maine LPCs and LMSWs may practice independently within nonclinical scopes. They are not interchangeable with LCPCs and LCSWs. Match advertising, assessments, treatment and payer applications to the issued credential. An entity registration, NPI or supervisor’s signature does not expand that scope.
Conditional credentials have different private-practice rules
Ordinary conditional LCPCs and LMFTs may practice privately under Board-approved supervision. Temporary conditional LMFT status instead requires supervised agency employment. An LMSW-CC needs clinical consultation and cannot use the ordinary new-license route to self-employed clinical practice. A private group’s employed role and a clinician-owned business require different analysis. Obtain Board guidance for the actual ownership, employment and supervision arrangement rather than relying on a contract label.
Use the current social-work statute when planning consultation
March 2026 amendments changed social-work qualification and consultation provisions, including eligible LMSW-CC consultants and the LSW/LSX consultation window. Some Board materials still show older requirements. Current law permits consideration of substantially equivalent prior experience for LCSW qualification without first holding a Maine LMSW-CC license; this does not authorize unlicensed clinical practice. Confirm the consultant, consultation format, setting and credited experience with the Board before relying on a plan. Historical CSW-IP and private-practice exceptions are not ordinary new-applicant pathways.
Review AI documentation tools as part of clinical policy
Maine’s 2026 law distinguishes administrative support, such as billing and scheduling, from supplementary support such as therapy notes. Supplementary use is tied to a recorded or transcribed session, specified written disclosures about the tool, purpose and data handling, and explicit, revocable written consent. Clinicians remain responsible for outputs. AI cannot make independent therapeutic decisions or communicate therapeutically with clients, and generated treatment recommendations require clinician review and approval. A client cannot be denied treatment solely for declining supplementary AI. Check the provisions for the clinician’s profession before adopting a tool.
