Start with license readiness

Your license type determines whether you can practice independently, need supervision, or should set up inside a group practice first. Confirm the current rules with the state board before accepting clients.

This table is a setup readiness starting point, not a substitute for current board review.

Use current supervision rules

Effective July 11, 2026, the mental-health board requires its alternative-professional-supervisor form when an applicant chooses a supervisor outside the profession. For new LCSW qualifying experience, use an eligible LCSW, or the psychologist/psychiatrist alternative only when the Board’s conditions are met. The statutory LMSW-supervisor transition ended March 25, 2025; older application-page lists should not be used to continue it. The July 2026 Register contains final counseling and social-work supervision amendments.

2026 psychology credentials need an implementation check

SS1 for SB208 was signed June 24, 2026. Section 25 calls for implementation at the earlier of June 24, 2027, or the Board’s published notice that final implementing regulations were adopted. An implementation notice was not verified in this review. Confirm DPR’s current process and the individual’s issued credential before relying on either new pathway. A licensed psychology associate and a psychological assistant have different practice authority.

Training and provisional authority are limited

A student placement, internship, temporary permission or provisional credential is not interchangeable with a full, unrestricted license. Verify the applicable profession’s conditions, supervision and expiration. DPR’s military provisional route is limited to eligible military members or spouses; it is not a general graduate-practice permit.

Licensed Associate Counselor of Mental Health (LACMH)No independent counseling authority; this is a supervised experience pathway. The Board must approve the direct-supervision plan before qualifying experience is acquired.Self-employment, an LLC or group employment does not remove supervision requirements.Verify the payer’s specific supervised-service rules before billing.LACMH supervision, § 3033
Licensed Marriage and Family Therapist (LMFT)Yes, within Delaware’s marriage and family therapy scope and the clinician’s competence.Authority to supervise an associate is a separate qualification check.A group’s registration does not license the clinicians working in it.Match the clinician, organization, service and location to payer records.LMFT scope and licensure, §§ 3051–3052
Licensed Associate Marriage and Family Therapist (LAMFT)No independent MFT authority; professional direct supervision is required.Obtain Board approval of the supervision plan before acquiring qualifying experience.Keep the associate’s supervised status clear in staffing and public descriptions.A supervisor’s contract alone does not establish payment eligibility.LAMFT supervision, § 3053

National steps

These steps are not unique to Delaware, but they still need to match the state, address, entity, tax, payer, and EHR details you use for setup.

  • Decide Type 1 NPI versus Type 2 NPI and whether the practice will bill under an individual or organization.
  • Create or update CAQH and keep attestations current.
  • Align EIN, W-9, business bank account, and payer-facing business identity.
  • Confirm HIPAA privacy/security, Notice of Privacy Practices, consent forms, Good Faith Estimate workflows, and documentation setup.
  • Select EHR, clearinghouse, billing workflow, payment processor, ERA/EFT workflow, and denial-management process.
  • Build a credentialing packet with license, malpractice, NPI, CAQH, W-9, bank documentation, taxonomy, service address, telehealth policies, and supervisor information if applicable.
  • Track payer applications, effective dates, portals, claim test dates, ERA/EFT status, and recredentialing deadlines.
Next step: clean up NPI and CAQHMake sure your individual NPI, organizational NPI decision, taxonomy, CAQH profile, W-9, and practice address are consistent before payer applications start.

State-specific steps

Business entity options

Choose the solo or group structure after reviewing the owners, professions and services with Delaware counsel. The Division of Corporations handles applicable formation, foreign qualification and registered-agent requirements; those filings do not replace professional or Revenue business licenses. A professional corporation has statutory restrictions on services, ownership and naming. Its allowance for qualified related professional services is not blanket permission for every mixed-profession therapy group. Confirm any additional program or facility approval for the services you intend to offer. For a public practice name different from the legal name, use the current trade-name process: new DBAs moved to Revenue’s statewide Delaware One Stop registry on February 2, 2026. Existing county-court registrations remain recognized; transfer to the new registry is optional. New registry filings require an associated business-license account. Name registration does not establish exclusive name rights or professional approval. Keep legal name, DBA, ownership and addresses consistent across W-9, banking, NPI, payer and patient-facing records.

Next step: align entity details with billing recordsBefore payer setup, make sure your entity name, EIN, W-9, NPI, CAQH, EHR, and bank details will all tell the same story.

State and tax registration

Determine federal tax classification, obtain an EIN when required, and set up income, estimated, self-employment and payroll-tax workflows as applicable. Obtain the Delaware Division of Revenue business license separately from the clinician’s DPR license. Review gross-receipts tax by business activity and applicable exclusions; it is a tax on business receipts rather than profit. Check state income and withholding obligations, and maintain entity-specific annual tax or report requirements separately from Revenue filings. Employers must address unemployment-insurance and workers’ compensation registrations. Confirm county or municipal business licenses, local taxes, zoning and home-office or occupancy requirements for the actual location. Use current agency instructions and an accountant for the practice’s tax treatment instead of assuming a single fee or tax rate covers every structure.

Next step: prepare EIN, banking, and payer paperworkUse the setup checklist to track financial setup before credentialing asks for tax and payment details.

Telehealth notes

Verify the client’s physical location and the clinician’s authority for that jurisdiction at each session. A Delaware license does not authorize care everywhere, and an out-of-state license alone does not authorize Delaware care. Interstate telehealth registration has eligibility conditions; verify the approved registration or individual compact authority before relying on it. The counseling board states that its compact is not yet live in Delaware. Chapter 60 allows a provider-patient relationship to be established remotely when the required standard of care is met. Verify identity and location, disclose the provider’s credentials, obtain appropriate informed consent, complete a clinically adequate assessment, arrange follow-up and provide a written visit summary. Counseling/MFT, social-work and psychology rules add profession-specific telehealth duties, including written informed consent and review of clinical and technology risks. Document emergency access, backup contact methods, confidentiality safeguards and how interruptions will be handled. The statute’s audio-only allowance is conditional; it does not promise payer coverage. Separately verify covered modalities, authorization, documentation, place of service and claim instructions with DMAP and each plan.

Next step: configure EHR and telehealth workflowsSet the client-facing workflow for scheduling, consent, documentation, payments, and billing before the first appointment.

Mandated reporting notes

Delaware requires any person or entity with qualifying knowledge or good-faith suspicion of child abuse, neglect or human trafficking to report to the Department of Services for Children, Youth and Their Families. Law-enforcement or internal notification alone does not satisfy that duty. Section 904 requires an immediate oral report to the DFS report line for specified urgent circumstances, including current injury, urgent medical or mental-health needs, hazardous lack of care, child death, or sexual abuse or trafficking when the alleged perpetrator has access to the child. Other qualifying reports may be oral or through the Department’s online portal. Licensed reporters must supply their name and address. For adults, § 3910 requires reports when there is reasonable cause to believe an impaired or incapacitated adult needs protective services; privilege does not remove the duty. Apply those protection criteria rather than age alone. Current Adult Protective Services instructions say to call within 24 hours of noticing suspected harm. Facility-related abuse or neglect may require the separate Division of Health Care Quality reporting process. Keep current reporting channels accessible to staff and use emergency services for immediate danger.

Next step: build forms and policy review into setupKeep clinical policies, privacy workflows, intake forms, and billing policies on the same setup checklist.

Insurance credentialing notes

Complete Delaware Medical Assistance Program (DMAP) enrollment for the intended provider category and service locations before entering a Delaware Medicaid managed-care agreement. MCO-only providers still need state screening and enrollment. The June 2026 DMAP FAQ distinguishes fee-for-service, combined FFS/MCO, MCO-only and limited ordering/referring/prescribing registration; the limited route is not authorization to bill treatment claims. Confirm the member’s actual plan, eligibility and benefits, then complete the separate plan credentialing, contracts and clinician/location affiliations. AmeriHealth Caritas Delaware, Delaware First Health and Highmark Health Options have their own participation workflows. Some behavioral-health services use state-funded or state-administered pathways, including PROMISE and children’s services; verify the responsible payer and any DSAMH or other program certification before billing. Do not infer a universal associate-billing pathway from agency staffing rules or a supervisor’s license. For commercial insurance, follow the current product-specific instructions. Highmark moved Delaware professional and organizational initial credentialing submissions to CertifyOS on October 5, 2026; practitioner CAQH maintenance remains necessary. Credentialing approval must be followed by completed contracting, network activation and confirmation of the participation effective date. Keep individual and group records, rendering relationships, locations and EFT/ERA current. A license, NPI, submitted application, supervisor or group contract does not guarantee panel admission or payment.

Next step: Map your payer listChoose target payers, gather packet details, and track every application through effective date and claim readiness.
