How to Start a Therapy Private Practice in South Dakota

To open a therapy private practice in South Dakota, first establish the clinical authority and permitted setting for every clinician, then complete business setup and the payer approvals needed for insurance billing. LPC is a full license; CSW private practice requires CSW-PIP. This guide covers solo, group, and hybrid launches without treating supervision, formation, or an NPI as permission to bill.

Start with license readiness

Your license type determines whether you can practice independently, need supervision, or should set up inside a group practice first. Confirm the current rules with the state board before accepting clients.

This table is a setup readiness starting point, not a substitute for current board review.

Separate clinical authority, private practice, and payer approval

A clinician may have clinical scope without permission to enter private practice or bill a particular payer. CSW clinical scope includes psychotherapy, but the board’s PIP contract expressly restricts private practice until CSW-PIP issuance. Medicaid candidate enrollment does not remove that restriction. Confirm the proposed setting before a candidate joins a group or launches a business.

Use issued South Dakota titles and approved supervision

The counselor board issues LPC, LPC-MH, and LMFT licenses. Do not import an LPC-A or LMFT-A title from another state. A postgraduate plan is a separate supervised status, while a fully licensed LPC is not automatically an associate. Temporary counselor or MFT authorizations are limited routes for qualifying out-of-state licensees, not a substitute for reviewing actual conditions and expiration.

Check current rules before relying on older forms

Counselor and MFT private-practice prohibitions in older supervision rules were repealed in 2020; that does not confer independent licensure on supervisees. Current counselor education statutes include program-start-date distinctions and compact-ineligible exceptions. Addiction rules were reorganized effective October 11, 2026. Use current statutes and board instructions rather than importing older hours, titles, or restrictions.

Keep practitioner and agency pathways distinct

A professional group is not automatically an accredited community mental health center or substance-use treatment agency. Those Medicaid pathways have separate enrollment, accreditation, and staffing rules. The October 1, 2026 independent-practitioner rule includes a narrow testing-personnel exception; it does not authorize unlicensed psychotherapy or routine use of a supervisor’s NPI.

CredentialIndependent practice?Supervision issue?Entity/business noteBomi relevanceOfficial source
LPC — Licensed Professional CounselorA full counseling license, not an associate credential. Current scope and the rule ending initial supervision at licensure support independent practice within competence and license conditions. An LPC pursuing LPC-MH needs the separate approved supervision arrangement for that designation.Use the issued LPC title; entity formation does not grant the additional MH designation.Verify the payer’s exact LPC category; Medicaid recognizes an LPC working toward MH under required supervision.Current counselor scope and licensure
LPC-MH — Licensed Professional Counselor–Mental HealthThe additional mental-health counseling qualification; licensed practice remains limited by competence and any individual conditions.Qualification supervision and approval to supervise others are separate from ordinary licensed practice.Align the actual license designation with taxonomy, marketing, and payer records.Individual enrollment, group association, covered services, and effective dates still require payer confirmation.LPC-MH statute and requirements
LMFT — Licensed Marriage and Family TherapistLicensed practice includes diagnosis and treatment within the systemic marriage-and-family-therapy scope and the clinician’s training.Postgraduate qualification supervision ends at LMFT issuance; supervisor approval is separate.Use LMFT only after issuance. A relationship-focused service is not automatically a covered medical benefit.Confirm individual eligibility and group affiliation for the specific network and services.MFT scope, licensing, and temporary routes
Postgraduate LPC or LMFT superviseeAn approved plan of supervision is not an issued independent LPC or LMFT license.Obtain board approval before counting qualifying hours; use an approved supervisor and appropriate setting.Use accurate supervised status. Confirm the arrangement before launching a solo practice or joining a group.Do not assume the supervisor’s participation permits the applicant’s services to be billed.Board supervision and practice-setting attachment
CSW-PIP — Certified Social Worker in Private or Independent PracticeSouth Dakota’s private, independent social-work authority, within the practitioner’s competence and specialization.Qualification to supervise CSW-PIP candidates requires additional board standards.Confirm PIP status before representing a social-work practice as private or independent.Enroll the clinician and connect the approved billing entity; the license alone is not a payer contract.Independent social-work practice requirements
CSW and CSW-PIP candidateCSW can include clinical social work, but CSW alone does not authorize private, independent practice.PIP qualifying experience needs an approved supervision agreement. The board contract says candidates may not enter private social-work practice before CSW-PIP licensure.Resolve the permitted setting with the board before forming a candidate-led practice or relying on a group arrangement.Medicaid recognizes an eligible CSW-PIP candidate under an approved plan; enrollment does not override the board restriction.Current CSW-PIP supervision contract
SW — Social Worker; SWA — Social Work AssociateThese lower-tier credentials do not authorize independent clinical psychotherapy.SWA practice requires CSW or SW supervision. Confirm the particular SW role and setting rather than assuming identical requirements for both tiers.A business registration does not enlarge the credential’s professional scope.Check any program-specific role; do not apply as an independent psychotherapist based on SW or SWA alone.Social-work license categories
Licensed psychologistIndependent psychological practice within competence and any license conditions.Supervising trainees or other personnel involves separate qualifications and responsibilities.Match advertised services and clinician titles to the actual psychology license.Psychotherapy and testing may have different provider, authorization, and personnel requirements.Psychologist licensing and provisional authority
Provisional psychologist or psychology traineeProvisional licensure and supervised training are distinct from unrestricted psychologist licensure. The provisional route is for supervised postdoctoral practice; applicable training exemptions and settings need individual review.Do not advertise training status as independent psychologist authority or extend a setting-specific exemption to an ordinary startup.A supervisor’s NPI is not a general psychotherapy billing pathway. Review any testing exception separately.Psychology provisional license and exemptions
LAC — Licensed Addiction CounselorFor a new entrant, private independent addiction practice requires an active addiction counselor license and at least two years of qualifying supervised work after initial licensure.Apply current Rule 20:80:13:06, reorganized October 11, 2026; verify the qualifying experience with the board.Do not equate initial LAC issuance with independent-practice readiness.Identify the addiction-service benefit and agency or practitioner pathway before payer applications.Current addiction independent-practice rule
CAC, addiction counselor trainee, or addiction counselor superviseeCAC certification and trainee or supervisee recognition are not the ordinary new-entrant qualifications for private independent addiction practice.Follow current recognition, supervision, and agency requirements; an outside supervisor is not automatically sufficient.Prevention and peer-support credentials also do not substitute for a psychotherapy license.Agency staffing permissions do not create unrestricted individual private-practice or payer eligibility.Current addiction credentials and supervision

National steps

These steps are not unique to South Dakota, but they still need to match the state, address, entity, tax, payer, and EHR details you use for setup.

  • Define the services, populations, office and telehealth locations, and self-pay or insurance model; review each clinician’s actual license and any private-practice qualification.
  • Resolve approved supervision and the permitted work setting before choosing a start date; retain the board’s approvals and current supervisor documentation.
  • Choose the business structure and public name with professional advice, complete required filings, obtain an EIN when required, and establish banking and appropriate liability coverage.
  • Prepare consent, privacy and security, records, telehealth emergency, child and adult reporting, and financial policies, including Good Faith Estimates for uninsured or self-pay care when required.
  • Align individual and organizational NPIs as appropriate, taxonomy, W-9, service locations, and payer applications. Use CAQH where requested without substituting it for payer-specific enrollment.
  • For a group, confirm each clinician’s individual eligibility and billing-entity association; retain approval and effective dates before advertising in-network participation.
  • Before billing, check the member’s eligibility, covered service, modality, authorization, actual rendering clinician, documentation, and the approved billing arrangement.
  • Assign responsibility for renewals, supervision changes, payer recredentialing, enrollment updates, and new or departing clinicians and locations.
Next step: clean up NPI and CAQHMake sure your individual NPI, organizational NPI decision, taxonomy, CAQH profile, W-9, and practice address are consistent before payer applications start.

State-specific steps

Business entity options

Choose a sole proprietorship or formed entity based on the proposed owners, clinicians, services, and clinical control. Have a South Dakota attorney review professional ownership, compensation, and any agency or facility requirements before filing or adding another profession. Secretary of State acceptance does not establish clinical authority. Complete the appropriate formation, registered-agent, and ongoing business filings for the chosen structure. A fictitious-name filing is generally required unless the name plainly shows each interested person’s true surname or is already on file in a required Secretary of State business filing. A DBA does not create an LLC or corporation. Keep legal name, public name, addresses, W-9, banking, and payer records consistent. Check the actual municipality’s zoning, home-occupation, occupancy, signage, and permit requirements before committing to an office; remote work does not settle local requirements.

Next step: align entity details with billing recordsBefore payer setup, make sure your entity name, EIN, W-9, NPI, CAQH, EHR, and bank details will all tell the same story.

State and tax registration

Obtain an EIN from the IRS when required; form an LLC or corporation before applying for its EIN. South Dakota taxes many services, but SDCL 10-45-12.1 exempts qualifying health and social services under specified classifications. Confirm how the actual clinical, consulting, education, and product revenue streams are classified with the Department of Revenue or a tax adviser. Exempt treatment revenue does not make the practice’s purchases universally exempt or eliminate possible use-tax obligations. Review federal tax, payroll, worker classification, and employer registration requirements; the Department of Labor and Regulation directs new businesses to register with its Reemployment Assistance Tax Unit, with tax liability determined separately.

Next step: prepare EIN, banking, and payer paperworkUse the setup checklist to track financial setup before credentialing asks for tax and payment details.

Telehealth notes

Confirm and document the client’s physical location at each session and the clinician’s authority to practice there, including when either person travels. South Dakota chapter 34-52 addresses appropriate licensure or specified employment exceptions, provider and patient identification, consent, a proper treatment relationship, suitable technology, follow-up, and records; an exception for a qualifying setting is not a general private-practice license. Apply profession-specific electronic-practice rules and an emergency and connection-failure plan. As reviewed November 3, 2026, the South Dakota counseling board says it cannot yet issue Counseling Compact privileges, and the Social Work Compact says multistate licenses are not yet available. Enactment or completed fingerprints alone are not permission for interstate care. PSYPACT is operational for South Dakota; eligible psychologists still need the applicable individual authorization. Telepsychology requires an E.Passport and APIT and physical presence in the declared licensed home state, with the client in a participating jurisdiction. LMFT licensure is not covered by the Counseling Compact. Use HIPAA safeguards and appropriate business associate agreements where required. For Medicaid, verify distant-site enrollment, covered procedure and modality, and benefit requirements; lawful telehealth is not a promise that an audio-only or video claim is payable.

Next step: configure EHR and telehealth workflowsSet the client-facing workflow for scheduling, consent, documentation, payments, and billing before the first appointment.

Mandated reporting notes

Create separate child and adult reporting procedures. Under SDCL 26-8A-3 and 26-8A-8, covered professionals with reasonable cause to suspect child abuse or neglect must report orally and immediately to the county state’s attorney where the child resides or is present, DSS, or law enforcement. The reporter who witnessed the disclosure or evidence must be available for questions during the initial report. Do not wait for proof or a routine supervision meeting. Under SDCL 22-46-9, covered professionals who know or reasonably suspect abuse, neglect, or exploitation of an elder or adult with a disability must report within 24 hours, orally or in writing, to the relevant county state’s attorney, Department of Human Services, or law enforcement. The statute’s exception applies when the professional knows the same concern was already reported to a proper agency. The child and adult deadlines and agencies differ; an internal note alone is not a statutory report. Use emergency services when immediate protection is needed.

Next step: build forms and policy review into setupKeep clinical policies, privacy workflows, intake forms, and billing policies on the same setup checklist.

Insurance credentialing notes

Start South Dakota Medicaid work with the state’s Provider Enrollment Portal, current enrollment chart, and applicable benefit rules. All eligible servicing and billing NPIs must be enrolled, and an enrolled group’s billing NPI must be associated with the actual eligible servicing clinicians. ARSD 67:16:41:03, amended effective October 1, 2026, recognizes psychologists, LPC-MHs, LMFTs, CNSs, eligible LPCs pursuing MH, and CSW-PIP candidates under approved supervision; it also addresses licensed LMFTs pursuing MH. A mental-health practitioner needs an individual NPI and may not substitute another provider’s NPI for the treating clinician. The narrow administration or scoring exception for psychological and neuropsychological tests is not permission for unlicensed psychotherapy. Use the current rule alongside the June 2026 practitioner manual and October enrollment chart; satisfy the category, taxonomy, addendum, location, assessment, treatment-plan, medical-necessity, and authorization requirements. A Medicaid candidate category never overrides the board’s private-practice restriction. CMHC and SUD agency enrollment and accreditation are separate from an ordinary therapy group. Primary SUD treatment requires the appropriate benefit rather than assuming it is covered under the independent mental-health benefit. Check the member’s care-management assignment and the Referrals manual, including exemptions and IHS/Tribal requirements, instead of importing another state’s generic MCO enrollment sequence. For commercial insurance, Wellmark directs practitioner and group applications through E-cred Central and tells providers to await written participation confirmation. Check each payer/product’s exact credential category, contract, group affiliation, locations, covered services, and effective dates. Obtain specific written instructions for supervised services and claim identifiers. A supervisor’s signature, group contract, CAQH profile, or pending application does not establish the clinician’s participation or claim permission.

Next step: Map your payer listChoose target payers, gather packet details, and track every application through effective date and claim readiness.
