Start with license readiness

Your license type determines whether you can practice independently, need supervision, or should set up inside a group practice first. Confirm the current rules with the state board before accepting clients.

This table is a setup readiness starting point, not a substitute for current board review.

Document the approved route before supervised work begins

RSA 330-A:10 still requires candidate documentation even though paragraph I of RSA 330-A:22 was repealed. Section 22 retains supervision approval and practice restrictions. Use the current Candidate for Licensure: Supervision Agreement and obtain the required approval before relying on the arrangement. For qualifying LICSW, LCMHC, LMFT and pastoral supervised experience in private practice, Mhp 300 requires a W-2 relationship with the site and rejects a 1099 independent-contractor arrangement. The supervisee’s own independent practice does not qualify. Psychology rules also reject the applicant’s independent private practice, even under supervision, as acceptable supervised experience. A group should resolve employment, supervisor responsibility, record access and coverage before assigning clients.

Use current applications and the actual issued credential

Mental-health, psychology and addiction professionals remain under separate boards within OPLC. Read current profession statutes together with the centralized RSA 310 framework; older forms may reflect provisions changed in 2025 or 2026. Mhp 300 includes February 2026 amendments and further social-work-associate changes in August. Initial mental-health applicants must meet the current jurisprudence-examination and criminal-history requirements. Conditional approval does not confer full independence. For the temporary out-of-state pathway, RSA 310:6 provides 120 days or action on full licensure, whichever occurs first, but a complete full-license application submitted before expiration continues temporary validity until OPLC acts. Confirm the issued status rather than assuming a pending application authorizes work.

Plan license maintenance, client rights and records from the start

For Board of Mental Health Practice licensees, Mhp 400 requires 40 collaboration hours every two years. Mhp 502 addresses practice-address reporting, license and Mental Health Bill of Rights display, accurate records and a professional will for record management during incapacity, retirement or closure. Its retention minimum is seven years after the last account activity, with minors’ records kept seven years past majority. Review any longer payer or other legal requirements. These Mhp provisions should not automatically be applied to professions governed by other boards. Prepare informed consent, privacy procedures, fees, emergency arrangements and a clear records custodian before opening.

Do not collapse different school and addiction credentials

A school-social-work license is not simply another name for LICSW, but its statute also does not repeat school psychology’s express setting restriction. Obtain scope confirmation for the actual services proposed. School psychologist-doctoral and school psychologist-specialist credentials carry the separate limits in RSA 329-B:15-a. In the addiction system, Certified Recovery Support Worker (CRSW) authorizes recovery support rather than independent psychotherapy, and Licensed Clinical Supervisor (LCS) is an addiction-supervision title, not a clinical social-worker license. Match the credential to both the clinical work and the payer category.

CredentialIndependent practice?Supervision issue?Entity/business noteBomi relevanceOfficial source
Licensed Clinical Mental Health Counselor (LCMHC)Independent clinical mental-health counseling with the full, active license and appropriate competence.Candidate and conditional statuses are different. Ongoing collaboration requirements still apply.Review professional ownership and the proposed public name.Use the actual New Hampshire credential in payer records.Clinical mental health counselors, RSA 330-A:19
Licensed Independent Clinical Social Worker (LICSW)Independent clinical social work within the full license’s scope.Postgraduate candidates remain supervised until the full license is issued.Entity formation is separate from clinical licensure.New Hampshire’s statutory term “clinical social worker” includes LICSW; do not invent a separate full LCSW tier.Independent clinical social workers, RSA 330-A:18
Licensed Marriage and Family Therapist (LMFT)Independent marriage and family therapy within licensed scope and competence.Conditional and candidate work remains supervised.Match professional ownership, authorized services and naming.Distinguish the full license from the supervised status in applications.Marriage and family therapists, RSA 330-A:21
Licensed psychologistIndependent psychology, including psychotherapy within competence.A doctorate, internship or postdoctoral appointment alone does not establish independent licensure.Psychology titles and professional-entity requirements need review.Verify the active psychologist license and the payer’s psychology category.Psychologist licensure, RSA 329-B:15
Licensed pastoral psychotherapistIndependent practice within the professional license’s scope.Prelicensure candidate requirements remain applicable.Ordinary clergy counseling and licensed pastoral psychotherapy are distinct paths.Check whether the specific payer recognizes this credential.Pastoral psychotherapists, RSA 330-A:17
Licensed Social Worker (LSW)A distinct, limited statutory mental-health scope; not equivalent to LICSW.The first two years require clinical supervision. The statute requires supervisor signoff on diagnostic assessments and treatment plans. Two years of licensure do not convert LSW to LICSW.Scope includes counseling and preliminary diagnoses for confirmation by an appropriate professional; verify the accepted payer role.Licensed social workers, RSA 330-A:18-b
Licensed Social Work Associate (LSWA)No independent clinical practice under this credential alone.Clinical supervision and diagnostic-assessment/treatment-plan signoff remain required.A business filing does not remove supervision. This is a distinct degree-based credential, not a generic title for every post-MSW candidate.Social work associates, RSA 330-A:18-c
Licensed school social workerA distinct Board license; confirm authority for the proposed private-practice services.Conditional status requires approved supervision.Do not assume LICSW equivalence or import the separate school-psychology setting restriction.Department of Education certification and the OPLC school-social-work license are different credentials.School social workers, RSA 330-A:18-a
Licensed school psychologist-doctoral or school psychologist-specialistNot a general independent psychologist license. The statutory school-related scope and setting restrictions apply.Outside-school services must relate to the practitioner’s students, school employment and school functioning.Do not advertise a general psychology practice or assume ordinary psychotherapy enrollment eligibility.School psychology restrictions, RSA 329-B:15-a
Mental-health licensure candidateNo independent practice; approved supervised work can occur in a private-practice setting. The approved agreement places professional, ethical and legal responsibility on the supervisor. The candidate’s own independent practice is not the qualifying supervised-experience route.Candidate documentation and supervision approval do not automatically establish a conditional license or payer participation.Candidates for licensure, RSA 330-A:22
Conditional social-work, LCMHC or LMFT licenseA supervised status, not full independent clinical licensure.Approved supervision is required. Conditional licenses generally last up to two years and may be renewed once.Business ownership does not upgrade the license. The conditional routes cover LICSW, school social work, LSW, LSWA, LCMHC and LMFT; pastoral psychotherapy is not included in Mhp 309.Conditional licensure and supervision, Mhp 300
Students, interns, residents and psychology postdoctoral superviseesTraining status alone does not authorize independent practice.Use the applicable education, training-site and supervision requirements.A training exemption is not a solo-practice license.Verify both the lawful placement and the payer’s treatment of supervised services.Psychology licensing and training exemptions
Master Licensed Alcohol and Drug Counselor (MLADC)The statutory scope includes substance-use, mental-health and co-occurring-disorder treatment.Independent practice still requires clinical supervision or peer collaboration.Obtain specific advice on entity eligibility for an addiction-only owner.MLADC is not limited to substance-use-only counseling; payer recognition is a separate question.MLADC scope, RSA 330-C:10
Licensed Alcohol and Drug Counselor (LADC)Principally substance-use-disorder scope; not an unrestricted mental-health credential.Approved clinical supervision is required. Co-occurring-disorder treatment has narrow statutory exceptions.Supervision remains necessary in a business setting.Check the actual credential, service, setting and payer’s supervised-provider rules.LADC scope, RSA 330-C:11
Temporary license for an already licensed out-of-state professionalOnly the authority actually issued under the applicable temporary route. This is separate from completing initial clinical training. The issued conditions and expiration must fit the launch plan.Verify issuance, scope, restrictions and the status of the full-license application.Temporary out-of-state licenses, RSA 310:6
Next step: confirm your state board rulesUse the official New Hampshire licensing source before you decide whether to setup independently, stay supervised, or join a group first.

National steps

These steps are not unique to New Hampshire, but they still need to match the state, address, entity, tax, payer, and EHR details you use for setup.

  • Decide Type 1 NPI versus Type 2 NPI and whether the practice will bill under an individual or organization.
  • Create or update CAQH and keep attestations current.
  • Align EIN, W-9, business bank account, and payer-facing business identity.
  • Confirm HIPAA privacy/security, Notice of Privacy Practices, consent forms, Good Faith Estimate workflows, and documentation setup.
  • Select EHR, clearinghouse, billing workflow, payment processor, ERA/EFT workflow, and denial-management process.
  • Build a credentialing packet with license, malpractice, NPI, CAQH, W-9, bank documentation, taxonomy, service address, telehealth policies, and supervisor information if applicable.
  • Track payer applications, effective dates, portals, claim test dates, ERA/EFT status, and recredentialing deadlines.
Next step: clean up NPI and CAQHMake sure your individual NPI, organizational NPI decision, taxonomy, CAQH profile, W-9, and practice address are consistent before payer applications start.

State-specific steps

Business entity options

Choose the proposed services, owners and management before selecting a business structure. A sole proprietorship does not create a separate legal entity. New Hampshire also has specific professional-corporation/association and professional-LLC statutes, RSA 294-A and RSA 304-D. Their professional-service definitions expressly address psychologists and independently authorized RSA 330-A practitioners. An ordinary LLC filing is not a substitute for reviewing professional-practice eligibility. For a PC or PLLC, ownership is limited to qualified-person categories; an unlicensed spouse or investor does not qualify automatically. Combining professions is allowed only to the extent the applicable licensing laws and rules permit the combination. RSA 330-C is not expressly listed in these professional-service definitions, so an addiction-only owner needs specific advice about the appropriate entity route. The entity must deliver professional services through authorized individuals and does not enlarge their clinical scope. Use the required professional suffix and a name consistent with the authorized purpose and title rules. Register a trade name when operating under a name other than your own legal name or the entity’s registered name; a sole proprietor using only their own name is not subject to that trade-name requirement. Calendar applicable annual reports for April 1 and trade-name renewal every five years. Review municipal zoning, occupancy, lease and home-office requirements for the actual location. Distinguish registered-agent, mailing and clinical service addresses, and check what will be public before using a home address. Have New Hampshire counsel and the relevant licensing authority review the actual ownership, credential mix and public name before filing.

Next step: align entity details with billing recordsBefore payer setup, make sure your entity name, EIN, W-9, NPI, CAQH, EHR, and bank details will all tell the same story.

State and tax registration

If forming an entity, complete formation before requesting its EIN and keep the legal name consistent across tax, bank, NPI and payer records. Establish bookkeeping and applicable DRA filings through Granite Tax Connect. The Interest and Dividends Tax was repealed for periods beginning on or after January 1, 2025; this did not repeal business taxes. DRA’s 2026 guidance lists the Business Profits Tax filing threshold as gross business income over $109,000 and the Business Enterprise Tax threshold as gross business receipts over $298,000 or an enterprise-value base over $298,000 for the applicable periods beginning in 2025. A filing threshold is not the same as a profit exemption or the amount on which tax is calculated. Have a tax professional apply the correct period, tax base, deductions, credits and estimated-payment requirements. The enacted $400,000 BET filing thresholds take effect January 1, 2027; do not apply them to a 2026 period. Before hiring, arrange payroll, unemployment-insurance registration with NH Employment Security, new-hire reporting and required workers’ compensation. Worker classification and the licensing rules for supervised experience need separate analysis; a 1099 label does not settle either. Review federal income and employment obligations alongside state requirements.

Next step: prepare EIN, banking, and payer paperworkUse the setup checklist to track financial setup before credentialing asks for tax and payment details.

Telehealth notes

RSA 310:7 is the central telehealth statute; the older mental-health-specific RSA 330-A:15-b has been repealed. Telehealth is permitted within authorized scope and does not expand that scope or remove supervision. Ordinarily an out-of-state professional treating a client physically in New Hampshire needs New Hampshire licensure or another recognized authorization. Section 310:7(VI) separately permits specified consultation or follow-up care after prior services in the provider’s licensing state; verify its actual application rather than treating it as a broad new-client exception. Confirm and document the client’s and clinician’s physical locations at each visit. New Hampshire authority alone does not authorize care for a client visiting another state. Use appropriate consent, secure technology, privacy procedures, emergency contacts, records and a connection-failure plan. For Medicaid, review He-C 5004’s consent, patient-rights, technical-failure and billing provisions. As of October 26, 2026, New Hampshire has enacted the Counseling Compact but is not on the Commission’s operational-state list. The Social Work Compact is not yet issuing multistate licenses. Neither enactment alone authorizes interstate practice. New Hampshire participates in PSYPACT; eligible psychologists need both the E.Passport and APIT authorization and must meet home-state and physical-location requirements. School-psychology titles do not automatically qualify. For plans subject to RSA 415-J, coverage protections include medically necessary telehealth, including audio-only care, subject to the statute and policy terms. Confirm the particular product, provider eligibility, covered service, prior authorization, place of service and modifiers. Legal authority and payer coverage remain separate.

Next step: configure EHR and telehealth workflowsSet the client-facing workflow for scheduling, consent, documentation, payments, and billing before the first appointment.

Mandated reporting notes

Any person with reason to suspect child abuse or neglect must report immediately under RSA 169-C:29–30. Call DCYF at 800-894-5533 for in-state calls or 603-271-6562; intake operates 24 hours a day, including weekends and holidays. If requested, follow the oral report with a written report within 48 hours. Provide the available facts rather than waiting to prove an allegation, and do not let internal consultation delay the required report. For adults, current RSA 161-F:43 and :46 address suspected abuse, neglect, self-neglect, exploitation or hazardous conditions involving an adult who is or was vulnerable at the relevant time. Vulnerability is a statutory functional standard, not simply being above a particular age. Make an immediate oral report to Adult Protective Services at 800-949-0470 for in-state calls or 603-271-7014, with a written report if requested. After departmental working hours, on weekends or holidays, the statute directs reports to the appropriate local police or county sheriff. Follow DHHS’s Long-Term Care Ombudsman route for nursing-facility or assisted-living concerns. Call 911 for immediate danger. Document the concern, reporting recipient, timing and follow-up while following applicable confidentiality and reporting law.

Next step: build forms and policy review into setupKeep clinical policies, privacy workflows, intake forms, and billing policies on the same setup checklist.

Insurance credentialing notes

Enroll with New Hampshire Medicaid through the NH MMIS Health Enterprise process before treating state enrollment as active. Use the application and provider category for the actual clinician, billing entity, role and service; the state overview distinguishes billing groups using FEINs, billing individuals using SSNs, and nonbilling rendering or ordering/referring roles. Rendering clinicians associated with a billing group need individual enrollment and group affiliation; an ordering/referring-only record does not replace billing or rendering enrollment. Reconcile license, NPI, taxonomy, tax ID/W-9, addresses and ownership information, and confirm the current instructions before submitting. State enrollment and each managed-care network are separate steps. The three Medicaid Care Management plans are AmeriHealth Caritas New Hampshire, NH Healthy Families and WellSense Health Plan. MCO applications can begin while state enrollment is pending, but the state overview says they cannot be completed until the Medicaid ID is issued. AmeriHealth Caritas NH uses a contract-inquiry process. NH Healthy Families distinguishes a new contract from adding a practitioner and requires current CAQH/NPPES information, Medicaid ID and the relevant profile or roster. WellSense brought New Hampshire Medicaid behavioral-health administration in-house on December 1, 2025. Its current contracting page requests a letter of interest and W-9; an executed contract and a welcome letter with the effective date are distinct milestones. Do not use old Carelon directions for current WellSense outpatient dates of service. WellSense also posts a September 1, 2026 taxonomy requirement for behavioral-health claims; follow its current billing and rendering taxonomy guide. For commercial coverage, identify the actual product and behavioral-health administrator. Evernorth, for example, requires current CAQH information, authorization to access it, an active license and a matching W-9. Track credentialing, contract execution, clinician/group/location activation, rates, EFT/ERA and participation dates separately. A group agreement does not automatically activate every clinician or location. RSA 420-J:8-c supplies limited payment protection while credentialing in specified circumstances, such as qualifying on-call coverage or an applicant already credentialed by the carrier in another state or through a New Hampshire employer. Verify every statutory condition and the plan’s applicability before relying on it; it is not universal provisional participation. Before insured visits, verify member eligibility, the clinician’s actual category, covered services, authorization and effective participation. Obtain explicit guidance for candidates, conditional licenses, school credentials and supervised addiction services; approval of clinical supervision does not by itself permit billing under a supervisor’s NPI. Watch current MMIS updates for the accelerated revalidation initiative announced in 2026 and respond to the notice’s deadline rather than assuming the usual five-year cycle. Applications, directory listings and fee schedules are not payment guarantees.

Next step: Map your payer listChoose target payers, gather packet details, and track every application through effective date and claim readiness.
