Does Delaware Medicaid Cover Supervised Unlicensed Therapists?

By George Ruan • October 30, 2026

There is no blanket supervisor-billing permission. Delaware’s adult behavioral-health manual expressly says supervised unlicensed psychology assistants and postdoctoral professionals cannot be billed under its licensed behavioral health practitioner section of the Medicaid State Plan. Separately, its outpatient substance-use program standards include supervised unlicensed counselors. These are different benefits and provider arrangements.

The source is the DHSS manual linked from its current provider page, retrieved October 30, 2026. The index labels it February 2026; the linked file is named Revised_08.18.26. Its reimbursement-rate scope covers DSAMH-contracted providers billing DSAMH or fee-for-service Medicaid, not noncontracted traditional FFS providers or MCO rates. DSAMH-only funding is not itself Medicaid authorization.

Can a psychologist bill for an unlicensed assistant or postdoc?

The manual’s pages 8–9 distinguish clinical supervision from benefit eligibility. Although it describes supervision of up to seven unlicensed assistants or postdoctoral professionals, it excludes their services from that practitioner section. It directs them instead to qualification under EPSDT, rehabilitation or home- and community-based authorities. A supervision agreement does not establish that another benefit’s qualifications have been met.

The independent LBHP list includes licensed psychologists, LCSWs, LPCMHs, LMFTs and LCDPs acting within their lawful scope. Medicaid participation requires current individual enrollment through DMAP. An associate credential is not interchangeable with the corresponding independent credential; this list does not establish a general LACMH, associate marriage-and-family therapist or student psychotherapy pathway.

What is different in an outpatient SUD program?

For ASAM Level 1 outpatient services, the manual describes licensed practitioners alongside unlicensed counselors supervised by a licensed clinician, certified peers and credentialed behavioral-health technicians. Unlicensed addiction-services staff must meet the stated DSAMH or credentialing-board requirements. Clinical supervision alone does not qualify any graduate or student for every service.

The program must meet the relevant licensing, certification and Medicaid enrollment requirements. Its Level 1 staffing provisions limit the qualified supervisor to ten unlicensed staff and require availability on site or by phone in a crisis around the clock. A peer may conduct individual or group work, but the manual directs peer-support billing unless that person also qualifies as an unlicensed counselor. Staff category therefore changes the payable service; it is not just a modifier choice.

Does this authorize private-practice supervisor-NPI billing?

No such general instruction is established by these passages. Program staffing eligibility does not make an unlicensed counselor an independently enrolled LBHP, and the manual does not supply a universal supervisor rendering-NPI instruction for that counselor. Match the program’s specific service code, qualified staff category and payer contract before choosing the claim identity. MCO contracting and reimbursement remain separate from the DSAMH-contracted FFS rate framework.

What is the practical answer for an associate or student hire?

For ordinary independent-practitioner psychotherapy, do not treat this manual as an affirmative answer for an unnamed associate license. For a credentialed SUD agency role, there is a defined supervised-staff pathway, but the individual and service must meet its requirements. For supervised psychology assistants and postdocs, the independent LBHP-section answer is expressly no; any alternative EPSDT, rehabilitation or community-based route needs its own qualification.

Frequently Asked Questions

Can a supervised postdoc’s services be billed under Delaware’s LBHP section?

The manual expressly excludes supervised unlicensed assistants and postdoctoral professionals from that section. It refers to other benefits only when their separate qualifications are satisfied.

Are unlicensed SUD counselors prohibited from all Delaware Medicaid services?

No. The manual describes supervised, qualified unlicensed staff in its program-based SUD framework. That does not establish independent private-practice psychotherapy eligibility.

Does DSAMH certification mean an MCO must pay the same rate?

No. The manual distinguishes DSAMH-contracted FFS reimbursement from MCO and noncontracted-provider rates. Enrollment, service eligibility and the applicable payer arrangement remain separate.
